    No, it isn't NC and NC alone. The percentage of people that get stuck in NC is minuscule compared to the back log due to inefficiencies.

    You can believe what you like, you can chose to in 1 breath quote from the Ombudsman report and then in the next, ignore what it states.

    The fact remains, the USCIS is very far from effcient

    I really do not know how you got to this conclusion. Everybody I know either are 1) stuck due to retro 2) stuck due to NC 3) approved within a reasonable period of time.

    Anybody knows what they will do about the whole firm being audited.

    Do not give misleading information. When you do the transfer the original visa is not cancelled. In fact you can have more than one H1B at the same time and work for them. For example two part time jobs for different employers. But the only catch you should always work only for the sponsoring company. If you decide not to join them at all, you can do so. But you have to maintain the status thru your current employement or another employer.

    Dude, I have to tell you the same, do not give misleading information. you need to have a full time position for H1B. there is a minimum number of hours per week that you specify on your Labor condition. 2 part time doesn't cut it. As I have mentioned before, you may have multiple sponsors but one of the sponsors should be primary and you work full time with him or the minimum number of hours per week as per LC. other one could be part time. But there needs to be 2 seperate independent I-129's filed by both employers for you to do this.

    Withdrawing funds from 401K before retirement is not a good idea. It is best to rollover the funds into an IRA at your bank.

    By the way, after the Patriot act is passed, you can not maintain financial accounts in this country after you leave if you are on H-1B. Uncle Sam is afraid you will be financing Terrorists. Another sucker punch. Take it like a (wo)man. :D :D

    Let me ask you the opposite question : How does NOT passing CIR help us ?
    I bet you don't have a convincing answer for that. Therefroe, it follows that CIR (even if it is not ideal) will be better than no bill being passed.

    And all those anti-CIR folks please get this : It does NOT give instant citizenship to anyone, nor does it put these folks ahead of us in the line. Thats just rhetoric from the likes of numbersUSA and lou dobbs blindly being parroted by some morons/idiots/imbeciles here. The core team had repeated this several times when CIR was under discussion. CIR is definitely not ideal for us because of the possibility of collateral effect from USCIS being overwhelmed, but is that worse than our current situation of waiting till retirement for our PDs to become current ?

    As rheoretro mentioned in an earlier post "Burning someone else's house down is not going to help us build our own". That is particularly true for us .. those who who are against illegal aliens are also against high skilled legals with a few honorable exceptions like Cornyn and Kyl. If that wasnt the case, the house and the senate would have passed SKIL in a jiffy by now. Its best for us to remain neutral on the illegal alien issue .. and back it to the extent that it benefits us through a piggy back ride.

    Actually I do have a convincing answer... whether or not that bill passes, we are in a lose-lose situation. I have read the bill (not in its entirety like I already stated). I know that the amnesty section already specified there will be no immediate granting of citizenship, excepting the wording for those who have been in this country for more than 5/6 years seems to imply they would get citizenship (again, the way a bill is worded can be twisted in future).

    What I am worried about is, I get the feeling this is going to end up dipping into our EB3 pool... we previously had a Sched A for physicians and nurses that took numbers out of EB3 exclusively for them.

    And I don't listen to Lou Dobbs or NumbersUSA rantings. But if you kept your ears open more than 6 months ago, you would also have heard some Dems says some not-so-friendly things about us.
    One prominent Dem senator said H1-Bs are not suffering as much as illegals.
    Another prominent Dem said this country needed more farm workers, not more IT / skilled ppl.

    To me it looks like a ploy by Republicans:

    1) To fracture the support for CIR and isolate the undocumented workers
    2) Republicans already enjoy support of the anti-immigration lobbies, what better than to add legal immigrant lobbies to their support base. Contradictory, yes, but a suave political move to confuse voters further.
    Strategically, when one doesn't enjoy clear majority support, this is a perfect political move.
    3) If this were a betting game, I would put my money on,"Nothing is going to happen on SKIL till after the Nov. elections" horse.
    4) If Democrats win the House in Nov. the SKIL will have trouble, because it is sponsored by Republicans. If Republicans retain the house, well, SKIL bill would have served its purpose.
    5) Even if House passes the SKIL bill Senate won't pass it because they already passed a comprehensive bill. They won't want to appear to be partial to legals and overlook the undocumented workers.

    These are my thoughts on SKIL bill as it stands today, I may be wrong.

    It is one way to reduce the budget deficit, each of us will be burning away $700- every year per head for AP + EAD renewal with close to a million applicants go do the maths.

    And AP/EAD renewal cannot start before 120 days so that time period every year for at least 3 years they are gonna laugh their guts out.

    And we thought we achieved a big feat with the July fiasco ......


    USCIS had given one week time to file for I-485 and then closed it. Later after the flower campaign they opened it up for a month. I mean to say, They had opened a small opening for us to get in. Now its our chance of how to get the opening bigger. We were successful by doing a flower campaign. We got to do more. The slot should be made more and more wider and should lead us to green card.

    All law firms hired by the employer will only respond or react to employer and not to the employee. Fragomen is very conservative (not 100% ethical) and will not take any chances with GC processing. Employers will always take the law firm's adivice because they dont want to take any risk either. Fragomen represent almost all of the fortune 100 companies, all of BIG4's, BIG 3's and all major consulting firms.
    If you (personally) hire Fragomen directly they will respond to all your queries in timely fashion. You will not talk to the lawyer at all. You will only talk to the paralegal. This is the problem with all big law firms.


    Again, the prestige of the law firm you hire does not have anything do with your application.

    Just called USCIS and told her that My application was mailed on Jun 28th and it got delivered on July 02. I also told her that my PD is May 2003 (hence i'm eligible to file in June)..

    She told me that since i mailed it in June and this Notice goes into effect in July 02 my application WILL NOT be rejected... She asked me to wait for receipt notice :)

    We have to come up with a request letter addressing to DHS secretary and I am pretty sure It can be done as part of admin fix.
    It will bring lot of relief for most of the people whose PD's are after May/June 2007..
    I know that its already on IV agenda, but looking at the complexity involved for H1 extensions/transfers/layoffs (especially these days) we cannot wait any longer. I would suggest keeping this particular request separate and especially people who have PD's after May/June 2007 should participate actively.

    we can come up with a draft letter addressing to DHS secretary and list out clearly how this would bring a great relief for us.
    PAPPU/MIRAGE/VDLRAO other senior member please provide your suggestions. Please help us join in the main stream (wait after applying for AOS :)

    This is different from what was done in July 2007. Back then all PD was current. This is to grant the ability to file AOS even when the PD is NOT current
