I do not think so. I believe these are two separate issues and should not have any effect on the chances of your frnd securing visa.

They can incorporate a company but they cannot do any work for it( not even write a check) or take any salary from it. But if the person has an EAD, there are very few restrictions.

I was told by my lawyer that I am eligible for the 245i and we are getting the paper work together. Here is my story:
My aunt filed for the i 130 in May 18,1994 for my mum (aunt's sister and her family). It was approved in the same year. While waiting for the priority date I aged out. I was in the US on a F1 visa and went out of status. We consulted many lawyers and the one we retained told me that we can apply for an F1 visa from a i 20 I had got from a school and we filled the paperwork and waited for over a year and half before it was denied. Then the lawyer told me I can apply for AOS through the 245i. We are going to apply for i 130 next month. I am getting ready to pay another retainer to the same lawyer and invest a decade in this process. I would appreciate any information.

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

Hi Gurus:
My wife got H1B approved in this year cap with validity date from October 1 2009. She is going to India for vacation during August 2009 and planning to go for H1B stamping.
My question is, whether she can go for stamping before October 1, 2009 which is the start date mentioned in I797 or she should go for stamping only after October 1,2009 ??

I've few questions related to I-485 filing:
1. I've single Date-Of-Birth affidavit from both of my parents, will that be an issue? Can USCIS issue me a RFE for not submitting two separate affidavits from each parents?
2. Will it hurt to submit copy of canadian green card having DOB as an additional proof? Also, I'd my fingerprints verified by FBI for canadian immigration, will that speed up my fingerprinting verification for US immigration?
3. I'm only submitting last year 2006 tax return in my 485 filing whereas my lawyers wanted last three IT returns? Will that be a problem?

Hi guys,
I am adding my wife's AOS application to my own pending AOS application. Because of whatever reasons we couldn't file our apps together earlier.
I notice that I need to give my wife's Alien registration no (ARN) at a couple of places in the application package, such as in the I-485 form, G-325A form, and at the back of the photographs.
Needless to say, my wife does not have an ARN. I was allocated an ARN when my I-140 got approved. Since she is just a derivative beneficiary, she does not have an ARN yet.
So what should I do about these columns in the form. Should I leave them blank, or should I fill them up with my own ARN.

My daughter is on F1 visa since she turned 22 years. She has her AOS (employment based dependent on me) pending. I-140 cleared and I -485 filed before she turned 22 years. She has also received her EAD and AP based on pending AOS.
We are planning to go to Canada and she want to use AP for reentering USA. My question is:
1) Once she enter USA using AP what happens to her F-1 status? Can she continue her F-1 status?

If you have a pending permanent residency application you should still be able to work under h1b status, particularly if your i-140 is approved.
