    Hello Guys,

    I need urgent help please.
    I am on 8th year of my H-1B, expiring on July-2008.
    I am on EB3 Nebraska, PD 07/2003.
    I-140 pending � RFE on Education (3 years degree) replied on December-2007
    EAD approved on September-2007.
    I485 aplied on july-2-2007

    Just got an email from Cris that my I485 was denied. I don�t know the reason.
    My I140 is still pending � almost 4 months after my attorney replied the I140 RFE.

    Today I am writing this in order to understand my available options and strategy to this situation.
    I have less than 2 months on H-1(b).

    What are my options?
    Anybody in the same situation?

    I was checking the http://congress.org

    I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.

    There are 100s of bills waiting for Co-sponsors published on this website.

    I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.

    This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.

    Any thoughts........

    You EAD or AP may be approved at anytime while your 485 is pending, it is a derivative benefit of the pending 485 petition. If the 140 is rejected then everything collapses like a stack of dominos.

    I'm very new here and I just got my H1B stamped to my passport. I'll be working in Tacoma WA. I wonder waht are the steps to issue a driving license in WA state. I have driving in my country for more than 10 years.

    Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.

    Hi,
    I lost my original passport and was issued a new passort which is valid till 12 feb 2007. I mailed my application to the indian consulate but they stamped the extension of passport for 1 more year. The first page of the passport say it expires the on 12th feb but on the next page th consular general stamped the extension of the passport till 12th jan 2008. I am goin to india on 26th jan for H1b stamping. I wanted to know what are the chances of the visa getting rejected at the US embassy. Alsp is the passport valid for travel

    As of April 15, 2010, approximately 13,600 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html)-subject petitions had been filed. USCIS has approved 5,800 H-1B petitions for aliens with advanced degrees.

    Many immigration lawyers are seeing a sharp decline in the interest in the H1B visa this year by potential employers and workers. Some are saying that the downturn in H1B applications this year could be as much as 60%. As a result of this decline, there are predictions that the quota will not be reached within the first few months of this year. Rather, many suspect that the bachelor's quota won't be reached until the middle of July, and that the master's quota won't be reached until later this June.

    We shall see how the number will play out in the next few months.

    I am currently studying in the US on an F visa and have managed to loose my passport a couple of months ago. The passport itself is replaced but I hesitated to renew the I-94 since it takes longer time than my duration of status and it is cheaper to just leave the country and send a mail to USCIS later with proof of departure.

    To the problem, I am changing status from F to A. Since the interview is not required I was able to obtain the new visa through mail. Now, I am currently in the US with a valid new visa but no I-94 which means I will be out of status two months after my F visa expires. Being close to the Mexican border my plan is to cross it and come back on the same day to officially get the A status and a new I-94. I will of course send photocopies of all the papers and stamps to USCIS to not fall out of status on the previous visa. Are there any legal problems doing this?

    Hi,

    My first NIW/I140 was concurrent filed with I485 for both my wife and me. When they denied I140, the USCIS also denied I485s for both of us. I have a pending MTR for that I140.

    I then filed another NIW/I140, which was approved. Surprisingly, and I just noticed that, the approval notice has the A# that was on the I485 of the first petition.

    So, should I assume that my the USCIS has interfiled my I485 automatically and my old PD is active?

    If yes, 1) Is there a way to confirm this, and 2) do I still have to file MTR for the my I485 that was denied, and 3) Since it has been 6 months since the PD, am I eligible for EAD under AC21?

    Also, what will happen with my wife�s I485? Since the original I485 was denied, will interfiling be okay or should we MTR it?

    Hello everyone!
    My wife has filed for my immigration and AOS around a week back. I would be expecting the biometrics appointment letter to arrive by the 25th of August. Now, I got a call from India yesterday informing me about my grandmother being admitted in the hospital, almost breathing her last. The doctors have all but given up.
    My question here is whether I can go to the USCIS office with the doctor's letters and all the remaining proofs to expedite my AP well before my biometrics are done? If yes, what else would I require in terms of documents? I can just barely wait getting it done, but I dont want to leave without the AP document.

    P.S.: I haven't yet received any NOAs.

    Got another question for Nikon people - a friend sent his D300s in for repair. Nikon upgraded the firmware, and now he can't open the RAW (NEF) files in CS3. Any thoughts?

    Anybody filed Un Signed Labor Substitution?

    Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.

    Any experince any body has, I request you to share that here.

    Chance of denial or rejection is very high if the Labor substitue application is not signed by the applicant.

    I left my Indian consulting company and the employer owes me $14,000 which he is now refusing to pay, he says he will deduct it as a cost of H1 and GC processing fees
    When I started working for him he told me that he would take care of all these costs(of course he did not give this in writing) and not at anytime was there a verbal or written agreement that I would have to repay him these costs if I left him.

    What recourse do I have now?
