    I am on H-1 B , and planning to apply for Labor certification - working for an Automobile manufacturing Company in Engineering department,my qualifications are Bachelor in Mechanical Engineering-SOC CODE (17-2141), Masters in Industrial Engineering SOC CODE(17-2112).
    my current job responsibilities matches with Industrial designer, Just want to ask in order to apply Labor can i use Commercial & Industrial designer SOC CODE(27-1021), also base cause for using this code is meeting Salary requirements, other two codes giving high salaries compare to this code which is matching my salary code, . help will be appreciated

    In my company along with me 4 other folks also affected due to visa bulletin mess. I sent them an email on July 9th 2007 about flower campaign organized by IV to USCIS director. The sad part is no body showed any interest and did not bother to reply. They are also going to benefited by this decision. These people still beleive in Murthy and other lawyer firm updates. I really don't know how to make these folks interested in IV. Any ideas or other personal stories.

    Hi,

    I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

    yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

    Hi!. I am helping my brother for his PERM. He has a BS Electrical Engineering in the Philippines. Is there a requirement to get an education equivalency assessment for PERM? Does he need to have a US Electrical Engineering license as a support for PERM as well?

    He has not yet started yet. We are still studying several options. He also has 7 years experience in the Philippines. Can that BS +7 years outside the US count for EB2 PERM?

    Hi,

    I filed for H1 petition in August 2009 and it is still pending. Meanwhile I applied for another H1B through a new employer (new employer took over my previous employers business) with premium processing. My latest H1B petition is denied citing Employee-Employer relationship discrepancies.

    My attorney basically submitted documents similar to what he did for all other employees but they all got approved. I dont know what went wrong in my case.

    I have a Master degree in Computer Engineering from a reputed school in this country as well. Please tell me what my options are to get back into H1B status and start working again.

    My wife's labor has been stuck for 2 years ( she got an RFE ). Her company lawyers arent too helpful and asked us to just wait. Wanted to know, what steps one can take to try to figure out what is happening.

    Hello,

    I have read in the popular immigration forums that one can request a one time 3 year extension to H1b beyond the standard 6 year limit if one has an approved I140 and could not file I485 due to retrogression. I am confused on how does one go about requesting this..meaning is it sufficient to just put three years under the 'date of intended employment' in I129 form and have a labor condition approval with similar dates or do you have to include a copy of approved I140 and point to the 2005 Aytes memo that grants such a provision while you file for I129. By the way the situation is also a bit more complicated due to the fact that I am changing jobs (5th year H1) and trying to get a 3 year transfer based on approval from the company I am leaving.

    Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit. The quota is 65,000 per fiscal year plus an additional 20,000 for folks with degrees from US advanced degree programs. Applications began being accepted on April 1st.
