    I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.

    I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.

    Please advice. What should I do.

    I am working on OPT and my spouse is filing AOS/EAD/AP. What happens till it is approved? Can I work?

    yes, you can work on OPT till EAD comes. Once EAD comes, just file a new I-9 with EAD and continue working.

    Remember, in OPT, you do not have to pay social security tax. Once you switch to EAD, you have to pay social security tax.

    I need an advice.

    Last year, I petitioned for my husband to get his green card and I was in a rush to get the application in before the application fee shot up, so I forgot to make copies of all the documents being sent to USCIS. Now, the interview is next week and I don't have a few of the documents that they want us to bring. It says that if already submitted, I don't have to bring in those documents, but I've heard that sometimes the interviewers still demands them during the interview.

    Is there any way of getting the documents from USCIS or is it lost forever?

    We will have the interview next Thursday, 21st of February.

    Dear lawyer,
    my I-485 is pending; PD is oct 05.
    my Labor Cert shows that we use job description of programmer/analyst. ETA Case shows title as "Software Engineer"
    I have a job offer in Information Technology, will there be any problems if I use AC21 with the new company?
    I have not yet accepted the offer.

    Hi, My name is Alex and I am a Permanent Resident for 4 years. I got married but my wife just have a turist visa B-1. So, I already applyed for her filling I-130. What is the next step? Just wait or can i fill out I-765 because she needs to work?... One more question...She still have I-94 valid for 6 months, does she need to go back to Brazil?

    My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.

    while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.

    Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.

    I would appreciate if you could reply me on this regard.

    it may be possibal, but thats really pushing the limit of flash. I whoudnt reccomend trying it, but thats kinda up to you. You shouldnt even think about it unless your an expert at actionscripts..

    Hello All,



    I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .



    My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?
