    if i was an EB-3 applicant (thats AFTER EB-2 and AFTER EB-1) i would be careful about who i call stupid and educationally unqualified.....chill big guy....:)
    if you read my post carefully (and if you can understand it) u'll notice that i called the "idea" stupid not the person. Filing in EB3 or EB1 does not prove your IQ.

    oooohhhhh by the way they never should ask money for this public service. They are just playing with us. There are similar things happened with USCIS and they got strong and angry reply from congress in the past. That is why we collectively need to contact congress...I wonder why IV is not forth forward in this effort from the gecko???

    That's not correct. Everybody pays UEI including the H1B people also. But if you are AOS status, the AOS demands you be in a job but it has nothing to do with UE benefits.

    The intent of this thread is good. There are however practical considerations.

    Many of us are from India. In the era pre opening up its economy, we had many well educated folks unable to get jobs there. The socialist strangle was such that highly educated people had no suitable jobs and private enterprise was actively discouraged. Many sought economic and professional refuge in more capitalist economies and to some extent we are still seeing the spillover from the policies of that era, with an excess supply of human skilled capital there and opportunities still not able to spread to the whole economy/population.
    The reason I am saying all this is, investing in skills like masters etc is generally a good thing, but not always. In fact there are many studies to prove this point, some demonstrate that too much education is a negative predictor of economic success.

    In our situation, capital is important, whereever we end up. Since in a capitalist model money works for you, and obviously if you have enough of it then you can spend your time doing other things, charity work or whatever warms your heart. Doing an MBA or any other higher education is very expensive in america. It is an investment. If you end up here, it will perhaps turn out to be a good investment, otherwise it will be of limited use to us especially in India, especially if a global recession hits.
    Pessimistic you say, lets reserve judgement on that and consider all of the geo political issues going on right now.
    If that is so the capital preserved by not doing an MBA in a top ten school which I estimate to be about 60-70K if I am not mistaken might be put to another use.

    What do you guys think about this line of argument.

    I am guessing the presumption behind logiclife's post is that we're all responsible, thinking and educated adults who shouldn't have to be begged and pleaded with to behave with decency or show some common courtesies at the least. If IV was formed a few months ago, then it's understandable tho not excusable that people who have legitimate ead/ap concerns just talk about it on the forum and then leave. But if someone's been around for more than a year and still has not participated in a meeting or contributed in other ways its truly pathetic. Even tho I don�t track every piece of news on immigration, I consider myself fairly well informed and day by day the outlook only gets scarier. Today at lunch, we were talking about junk forwards and poking fun at those who send them and a friend mentioned how he has been getting so many fwds with anti-immigrant messages these days(my friends are obviously pro-legals, somewhat ambivalent about illegals but not the lou audience type & don�t lose sleep over a bunch of poor busboys/gardeners crossing the border). This anti movement is growing powerful by the day with clear agendas and goals but theres no countervailing pro-movement to speak of except iv, only sympathisers. Yesterday Lou was on tv promoting his book to princeton club in new york. After Lou had chewed off on the illegals in response to a question, another member conveniently queried him on what he thought of the top end of the immigration spectrum worked. After labelling H1b a disaster(in other words people like us are here in the US because of a broken program) he sought to portray congressional hearings as some farce as apparently only Bill Gates was invited to speak this year. He ofcourse didn�t mention that orgs like CIS, numbersusa and others were invited last year when his friends like Tancredo were running congress, orgs that would be labelled as hate groups in normal times in the halls of congress helping set policy! And then he said that 75% of H1bs goto Indians in the US who work for Indian companies domociled here to just to outsource American jobs. Not only did he make a chillingly racist assertion based on a complete lie, he was implicitly advocating shutting down the only legal avenue to immigrate for people like us who didn't win a genetic lottery and were born into the right family! This, in New york of all places and that too at Princeton club after dissing about 'elites' and how 'acquiescent' some were!! Voicing some legitimate concerns of the common man along with radical or divisive agendas are nothing new but he's taking it to new levels. That's why as someone else already said elsewheer, iv shld be more than a bulletin board to discuss legitimate ead/ap concerns- it�s the only openly pro-immigrant(EB)movement. There are a few opinion journalists penning a piece here & there but that doesn't help much. Some of us are in cozy well paying jobs who are certain to get gc's and can wait however long it takes but that�s no reason to sitby and let others who are not so certain about their future struggle alone. And finally, we all have been yelled at and its not the end of the world so getover it dontr be such friggin crybabies!

    Hey, mine is EB2 ROW - can't get any more straightforward than that, I-140 is approved, and PD has always been current! Well, 1 year 7 month and still counting. It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.

    Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

    No, it isn't NC and NC alone. The percentage of people that get stuck in NC is minuscule compared to the back log due to inefficiencies.

    You can believe what you like, you can chose to in 1 breath quote from the Ombudsman report and then in the next, ignore what it states.

    The fact remains, the USCIS is very far from effcient

    I have been member of IV since Dec 05. Probably since a couple of weeks after it was founded.

    In last 2 years, I have seen many ups and downs with this org and there are numerous stories to share in my work with core and grassroots, with lobbyists and congressional staffers, with friends and colleagues.

    But what has been happening in few places lately is something that those responsible should be ashamed of.

    On saturday IV chapter leader in Texas Needhelp! had organized a local chapter meetup. Now you may ask, oh, another one of those. What do they do anyways?

    Well, here is what we do in chapter meetups.

    WE WORK.

    We find groups that can be formed to meet local congressmen. We refine talking points. We share updates that we dont usually share on website. We help new members get up to speed. We sometimes get local immigration attorneys to answer questions on pro-bono basis (yes, that means free for you) to serve the community. Lawyers get free publicity, we get free legal advise. A symbiotic quid-pro-quo.

    This is what happened this weekend in Plano TX (Dallas Suburb).

    Now mind you, Dallas area alone has probably atleast 300 registered members. Not to mention the lurkers for whom I have a special message below(at the end).

    This is what she (Needhelp) reported after chapter meetup.

    Most members who were expected to show up did not. I spent whole morning preparing this, I feel guilty that I made my daughter miss her dance class and then those who had RSVPed didnt show up.

    Yep. She missed an extra carricular event important to her daughter for this meetup.

    Dont even get me started on those who live 10 miles from Plano Texas and dont bother responding even.

    You know, when someone arranges to send you details in email and you know about it, you say you will attend and then you dont, what do you think is going to happen?

    IF EAD IS THE END OF THE ROAD FOR YOU...

    If EAD is the end of the road for you, then why are you still coming to this website. There are about always 600-700 people on this site during the day and about 300 people at night. Who are these people?

    The truth of the matter is, the ones who dont contribute, have stopped contributing, or have never contributed funds, attended events or given anything to this org - but still keep scouring theads - are the people to be pitied. You will always be worried. "Mera kyaa hoga". (what will happen to me). Your journey wont end. Ever. Even after getting GC you will be worried about citizenship. Even after getting citizenship, there will be small itch in your head - what if my citizenship is revoked (yes it can legally happen and has happened to a WWII genocide guy in 2001-2002 timeframe, go google it and ruin your rest of the day).

    The truth of the matter is, right now, even after getting EAD, then only action you have taken is either stopped contributing funds, or stopped giving any of your time to this org.

    But your life has not changed one bit.

    You probably wont even use your EAD or change employers. You will constanly be worried about your namecheck, your fingerprints, your this, your that. You will be worried about new inquiries and RFEs coming on your approved 140 (approved years ago) during 485 processing. (yes that can happen too). You will be worried about accidental rejection of 485 (that's why most of the people wont even use EAD and continue on H1 to preserve option of using appeals process to appeal 485 rejection on H1). You will be worried about USCIS not buying your AC21 portability and sending your RFEs to prove that the ported job is "Same or similar" in nature. You will be worried about being unemployed for few weeks at a wrong time just about when 485 RFE comes and you dont have a letter to show you have a job offer to justify 485 approval.

    So basically the struggle hasnt ended. Yes, keeping looking at your EAD in your wallet every 3 minutes, its still miserable.

    So why not act to end the misery rather than scour forums and comiserate. Is it that much fun to comiserate and is it that much pain to co-operate?

    THE LURKERS ON THIS SITE WHO WILL NEVER REGISTER OR DO ANYTHING AT ALL.

    Not to mention how many cowards (yes, cowards who think that by registeration on this website, the USCIS will send a black helicopter to their home and abduct and deport them, the ones who have watched the movie "enemy of the state" too many times and think that there is a Jon Voight out there who has nothing to do both to pluck legal skilled immigrants and throw them out). I have a special message for those lurkers who need this website and visit it everyday but dont have the balls to register, share email and participate in any activity. This isnt about a chapter meetup, or your greencard or even this org. Your reluctance is not a reflection of your over-cautiousness. Its a reflection of your character. You will eventually get greencard, become citizens even, but this kind of cowardly attitude will made you lead a boring, uneventful and mediocre life.

    And by the way, if the government was really after you, they would have already gotten to you for browsing this site too. Dont you think they (the black helicopter guys) can find our who you are while you are lurking? Ever heard of IP addresses? If I can find that out then they can do much more.

    Hello ... I m responding to a some one who dis-respected my fellow citizens . So what do you say English speaking guys are great IT professionals ? To work on computers you need brian and understand bits and bytes not english .

    I think you got my message wrong all I m saying is you dont have to be a great english communicator to qualify for EB2 , unless you are applying as professor .

    In 70s most of the towns having only local language schools and stuided in local language schools , thay may be part of reason why some of them dont communicate well ..That doesnt mean they can not work on computers ...


    Well thats our opinion/preception or even truth. If you need to work in the US, you need to be good in english as its their national laungage.

    Based on the reply to this FOIA from Needhelp!, it seems that we have a bigger problem than transparency.

    They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability. If you have 500,000 pending cases and dont know how many cases for each country of chargeability, then the only way to respond to a visa bulletin is to go thru all 500,000 cases every month, take a peek in it, look at the PD, look at the country and see if it is up for approval. I dont think they are doing that.

    Also, if priority date is something that is different for different countries, then cases for those countries have to be sorted by priority date in different silos, so that when the next bulletin comes, you know how many cases are eligible that month and which ones are the earliest cases (from PD perspective) for each country.

    Their systems are not designed for country chargeability and priority date considerations. Although some of the information is in computer systems for reporting, publication, online status, automatic emails, etc, most of it is paper based. They claim that they process cases in order they (physically) receive them at each processing center.

    Possibly, what they do is that they pick cases from shelves in sequence they stacked when they received them, check various docs such as medical, birth certificates, copie of I-140, passports, etc., and then, if all ok, check for country of chargeability. If that is India or China, then they look at the current bulletin dates. If case is within cutoff dates, proceed, else put it back, and take next file.

    Therefore, they are correct in saying that chargeability is determined (means: looked at) when case is ready (meaning: it is next in line) for reviewing and adjudication.

    Note that there is no physical file sorting based on chargeability/PD etc. Bulletins are just best guesses based on general progress in preceding months.

    Campaign contribution is the lubricant oil of politics (all pun intended - big oil is the biggest contributor to both parties).

    Strength of IV & the skilled immigrant community should translate to campaign dollars. If the skilled immigrant community is in powerful positions in big firms, they can influence company contributions. Same applies for companies (to be) founded by immigrants.

    We need to put our money where our mouth is.

    Thanks for your message. I just wanted to clarify that no IV member should contribute or volunteer for a lawmakers election efforts because it is illegal to do so. Only US citizens can do that. We can only influence indirectly.

    Get copies of your 140 approval and labor filing papers. Look for a job and transfer h1b , you will get 3 years transfer/extension based on yiour approved 140.
    Once you settle down in your new job, apply for new Labor in PERM (preferably EB2) , and you can port your earlier priority date.

    Yes, thats true. I was wrong in mentioning April 2008. You might get a new H1 for 3 years based on approved I-140

    Corruption is everywhere equally - US and India.

    Difference is how they do it. US, its what they call it legal corruption. In india, we truly follow the meaning of corruption ( illegal ). Better this way.

    Examples

    Phones - In US, you want to connect, disconnect, block, unblock - everything has a God Damn fee.
    Banks - Same damn thing.
    Trollies in airport - You dont pay for that in India ( 3 dollars you pay for trolly, 50 rupees to cooley in india, hey i save 100 bucks )
    Auto Insurance - Thats probably the bigest scam in many ways
    USCIS - Just do a math on how many dollars you have spent for your GC from day one ( could have bought an house in india )

    If my attorney is to be believed, USCIS will clarify on Wednesday regarding whether/how to file without receipt notice.

    BTW turns out I'm with Nebraska SC too. I had just assumed I would be in TX given that I live in TX! :D


    Lets wait till Wednesday then.
    I still believe we should be able to get the receipt numbers by 1-Aug.
