EB3 porting is a loophole like labor substitution.
 
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
 
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
 
 
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

When exactly did you submit your application? I just called a few minutes ago to ask about mine (which was submitted early May) and the guy said I should not be affected by this as I should already be well into "the process by now" meaning I should have already been assigned a visa. He spoke very very slow...so I don't know if he was 100% sure of what he was saying:confused:

First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

This is in response to the poster indicating that H1B cap includes h4 time. This was changed in the 2005 interim AC21 memo which decouples h1b and h4 visa status durations. H1 Time does not include time spent on H4. Anyone on h4 can always get a new h1b term for 6 years.

H1B transfer to another company does not automatically invalidate the existing H1B.
 
From his post it seems he was always in status and on H1B with some employer. He at some point thought of joining employer X, filed for transfer but then refused to join them.

When I got laid off, my lawyer at the time told me that technically you are out of status as soon as you leave payroll. There was no such thing as a "grace period". I was advised to change my visa status to B2 (I think it was that) with immediate effect, if I could not find a new job within 2 weeks to complete an H1B "transfer". It isn't exactly a transfer of the visa, but what you would do normally when you are changing employers whilst on H1 B. I was told that the "maintaining status" was verified by payroll dates, so within the 2 weeks (I was paid bi-monthly) would be safest

To give a simple example, our company is looking for people in Australia, Denmark, Finland, Canada and UK since the pool of qualified people in India has dried up in our field. Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
This is why it is in the best interest of companies to support EB GCs.
My friend Senthil makes the same mistakes (repeatedly, unfortunately):
(A) Assuming that "good" companies will not be affected by any change of increase in fees for H1B, since they presumably have unlimited pockets and unlimited access to unlimited talent. (Big ha!ha!)
(B) "Good" companies can always get to hire people in US if they exist, and the only reason they hire H1 is that they cannot find anyone in US as there is no one in US who is good enough for the job for love or money (Bigger ha!ha!)

Arunmurthy, Please dont drag UP/Bihar. Bihari are proud indian too. I am not bihar but narrow minded guy like you talk all this nonsense. People from south may be educated, techy but very discrimating and hyprocrate. Most sound indian just hang out on their identity group and we all know if non south indian and south indian go to interview for tech job and person taking interview is from south, who gets job?

FYI..
I received my second AP renewal within 30 days of filing. It was paper based filing. In the process I lost 2 1/2 months of my previous AP approval, which was valid till August '09.
Seems like they are processing AP very quickly.

"My wife's employer filed for her GC during 2007 August rush for all of us. Her case is in EB3 with Feb 2005 PD. My labor is approved and filed for I-140 about a year ago and still hasn't been approved. Now, my PD is current based on yesterday's Visa Bulletin. Can I file another I-485 for me with a pending I-485 thru my wife's employer?"

yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.
OR, you can wait, and once your 140 is approved and provided your PD is still current, you can transfer your wife's 485 to yours making you the primary and the wife the dependent.

Sorry for late jumping on this old topic. But, applied for SSN for my wife and got it in mail. Now what? My taxes for last year were applied in feb this year. How can I tell IRS that my wife got SSN now and she is eligible for Stimulus package?
 
Can I claim this amount next year when I file my taxes?

You can file an amendment with the ssn information. If you are not sure how, just talk to any cpa.
