Pressure from airlines to keep schedule and minimize fuel expense in the form of performance review/rewards/bonuses. Strong captains can resists but the pressure is constant. Not much unlike Health care companies that reward primary physicians that give minimal referrals to specialists. Such doctors are rewarded with free lavish vacation.
And then complain about lawsuits waiting on their door after their return from vacation.
I doubt what you are saying is true in US. Lawyers are waiting such things to happen and screw the hell out of doctors for malpractice/fraud.

My wife and I got involved with IV activities/volunteering about 2 months before the rally....and we are very glad we did!
Its been a very rewarding and learning experience....after meeting with the lawmakers- it has fortified our belief in IV and renewed our enthusiasm about the process. After reading Logiclife's post I am convinced that active participation is the key to achieving success!
We plan on continuing our efforts - turning sceptics into believers - it is especially needed in the DC/VA/MD!

Hello,
I'm also in the same situation. My labor is approved May 2007. I'll need to apply for both 140 and 485 together. Can I do it at the same time ?? or do I need to file my 140 immediately and then 485 after a few days. Time is running out now, as we never know when USCIS would again stop accepting 485s. Please advice.

I read through your reply, however, I found it extremely hard for me to accept your points. You've been probably on EAD too long to remember what a dire condition you came from as an H1B worker. Let's look at it:
As an AOS, you can:
- Work for any employer
- Not work at all
- Travel out of the country without worrying visa delay
- When you got laid off, no need to worry about being out of status or restarting GC
As an H1B worker:
- If you are laid off, everything, years of wait, thousands of dollars, down the drain, and the whole family becomes out of status immediately. And in this dire economy, this is a sword hanging on the head of every H1B worker.
- Worry about re-entry visa each time you travel
With such a huge different, I can hardly convience myself that EAD is 'useless' or 'waste'. True, you'll need to work for same or similar job, but compared to the benefit, it is not nearly as big a problem faced by H1B workers day by day.

It is just a matter of time before USCIS starts issuing RFE or denial notice on EAD\485 as well. The prime candidate for USCIS to kick out people using EAD\485 is the same or semilar job restriction while using EAD\AC21. If everyone gets to pre file AOS without PD restrictions then USCIS will make using EAD as difficult as using H1b. Please fight for the removal of "same\semilar job requirement in AC 21" along with prefiling AOS so that everybody gets true relief and it really becomes a win win situation, otherwise it is a waste and will speed up uscis making life miserable for EAD workers.

My case was similar as yours. USCIS just sent a Denial on my 485 without sending a NOID in May. If 180 days have been passed on your 140 approval, then you are safe. If your employer revoked your 140 within 180 days, then you have a problem. Normally desi employers revoke 140 because of Ability to Pay issue etc. especially when you move to a different company. Good thing is that you still have your H-1 to fall back on.
Anyways, My case was reopened within 2-3 weeks after we filed MTR and got a copy of the decision. Filed EAD and AP renewal this July.Got EAD and turns out they denied my AP based on the previous 485 denial in May and didnt even look that they have reopened my case in June. So fighting with USCIS Nebraska center on that right now ! Too infopass and the Immigration Officer is supposed get the information corrected on my file and get my file reopened for AP. Really dont think they look into their own notes or paper work even when issuing denials.

I totally understand the push from IV to encourage state chapters and build grassroots strength to this movement.
Join the state chapter : IV does not have a state chapter in the state I live in - Nebraska,: So I thought I would start one and wrote to IV ...after initial response from IV , there has been no progress .
Start contributing: I have already contributed $100 and will contribute further as and when I can.
Volunteer for IV: Volunteered to start the state chapter.
Well I have done my bit so hopefully I will not be disparaged for making comments on this issue,

Very good. If I can go, I am sure you can go too. If I can afford to buy some plane tickets, you can too. If I can take a day off, you can do it too. This little time and money is nothing compared to your next few visits to your attorney's office when is time to renew that I am sure you're tired of doing.
I want to do it for my family, you do it for your family and then educate somebody else so they can go too. Next thing you know, we'll be a lot and we'll be heard.
If you don't go to D.C. you'll feel bad when you see that we succeeded and you did nothing about it!!!! just taking a "free ride" All of us are enjoying the results from the flower campaign and the S.J. rally. So we know we can do it again.
When you get your GC faster than expected, you'll feel so guilty.

The reason H4's are ignored, is that 90% of them are woman. Most H1b Contractors come from third world countries. And most men would like to see their wives as housewives only. Also woman are less aware of socio-political issues. When they understand, they can't work on H4 visa, they just accept it as their fate. they never ask for more .
Unless the women on H4 starts to speak up and spread the awareness of H4 issues, getting work permit for H4 will always remain a dream. even though few woman activists are trying to lobby for it. We have educate the Congressmen that Woman on H4 needs to have Work authorization. It is not a privilege. It should be a right. I think ImmigrationVoice should put H4 Work Authorization in their agenda.

This is not an attack post. Or a criticizing post. This is purely educational and please keep this thread clean.
I know there are many out there who are snickering in their cubicles looking at the pictures of the rally and thinking "Look at these idiots, they think Congress will pass SKIL bill because they walked 1.2 miles with some placards and banners".
Such thinking is reasonable. But only if you dont know how things work.
Here is why rally of Sept 18th will be consequential:
1. When you do a rally, people notice. People recognize organization and measure its strength. It stays in their heads for a long time and they keep Immigration Voice as one of the organizations they can ask for support when they push for their own cause. In Congress, things work based on compromise, consensus and consultation. People dont just sponsor legislations they believe in. They run it thru their caucus and leadership and do a vote count. To find out how many votes would they get if they came up with this new idea. Whether it will get 218 votes in House. Whether they will get 51 votes in senate. If its filibuster proof and get 61 votes in Senate. Whether it has committee support. Whether leadership offices are in agreement to put it in schedule. All this happens in background and there are people who are hired in committees just to do vote counts on proposed ideas. IF it turns out they dont find enough support, they drop it. If they think they can pull it off, they approach leadership (Speaker in House, Maj leader in Senate) to put it in queue.

Let us say that Congressman X wants to sponser SKIL bill because of his constituency or a senator (like Feinstein) wants to sponsor AgJobs because food growers are having food rotten in absence of agricultural workers, a compelling cause. Now, when they want to pass legislation, they have to look for support and votes as described in item 1. When they fall short, they find ways to sweeten the pot. IF they see that a powerful organization will throw in their support and lobbying in favor of their bill if they attach a few of that organization's provisions, then they approach them. Immigration Voice did 138 lawmakers meetings (in House and Senate). They did the rally. They would consider IV as a organization that can help them PUSH for their legislation. Now we have a place at the negotiating table. If they attach our provisions (like recapture, or GC quota increase), then we can promise to do something for them. Like support the entire bill they are pushing for. They know that we can do rallies and we can do hundreds of lawmaker meetings. If Diane Feinstein (just an example) thinks that by adding skilled employment based reform provisions she can get IV's support and swing a few votes to help her pass her favorite AgJobs bill, then we have opportunity where the Senator would ask us what we want rather than us going and asking them to do things for us. One of IV members said that on the day of the rally, suddenly the office of her senator called her and scheduled and appointment to meet the same day at 4:00 PM. She had been trying to get the appointment but after they rally and Roll call newspaper ad (http://immigrationvoice.org/media/forums/iv/rollcal3a.pdf), they called her to listen to her. I heard about this from her just as the rally was over.
3. CIR has recently failed. From some meetings, I got the feeling that CIR's failure has left a bad taste in mouth and many people in Congress as well as administration are very upset about it still. Now that we have done this rally, done lawmaker meetings, put a rollcall ad, did the media blitz, press conference, congressional reception (where 4 congressmen attended and spoke in IV's support), they know that it would be a good idea to keep IV on their side and put some of their things in a bill. Next time they write a bill (behind closed doors very often), they will consult us and ask us if they can do something for IV to win IV's full support. That's because by getting IV's support on their side for whatever they are doing, they can be assured that we wont oppose it but instead support it. With phone calls, Rallies, paid ads, lawmaker meetings etc. If they are really investing in getting a bill passed, they would include our provisions just to increase the odds.
Strength respects strength. If we have the strength to do things and make a difference (rallies, meetings, receptions, press conferences, paid ads), then that strength begets more strenght because other powers want us to join hands with them so that they can do their favorite things (AgJobs, DREAM etc).

I sent my EAD paper file on 29th May to TSC. I received my EAD's today for 1 year. Cutoff date for 2 year is 30th june.
