Here's my Tragic Story.... I just couldn't sleep since Monday !! ! ! !
My PD is May 2003 - EB3 and my stupid lawyer sent it on Thursday ( 2nd Day Air) and it reached them on July 02. Do you think if i have a chance that USCIS will accept it.. I called the Service Center and they didn't hv a clue on it yet... Atleast if USCIS can accept the appln.and provide Ead/AP that would suffice for now..
Any thoughts ????

People who feel happy at other people's sorrows don't deserve here. Today in the moment of happiness you only came to spoil the mood and want sympathy from everyone. Your previous posts were VERY offensive. Do not act innocent. I saw them saddistic remarks.
Infact a lot of backlog center people started posting offensive remarks and showed happiness when dates became unavailable. I will never support you guys after what I saw from you as reactions.

My two friends are leaving.
They are completing six years. Their labour is approved. but I 140 is not approved.
They applied for their labour in sixth year.
Due to retrogression they are unable to apply for I 485 and EAD. They are working as DB2 DBA's.
They choose last option to leave the USA.

I recently sent a letter to the USCIS Director Explaining the problems faced by H4's because the stay in H4 counts towards the H1 time. Just to bring up the matter of Decoupling H1 time and H4 time. May be it was long forgotten in the bureaucracy.
I couldn't find an email address of the USCIS Director, Not even a full Address.
I used the address below. It might reach there or come back to me.
If it reaches there and if I receive a response I will post it.

It happened because of relentless canvasing of the media until the story got out and embarrassed the government. "Supporting the troops" is a no-brainer for a politician wanting to score political points. Most Americans could care less about immigrants or other citizens who are married to them. So there is no political urgency to solve that "problem." Although the media has reported that the exclusion of legal immigrants was "unintended," my sources say that the exclusion was intentional.
I had hoped to embarrass the government further by exposing the connection to a known "hate group," but the media has refused to report that part of the story. If I could get the media to expose the racist origins of this law, we might have some hope, but don't count on it.
The next phase is to focus on legal options.

Now that they have separated out the army folks, there is very little chance for a separate initiative only for the legal immigrants.Anyway the Govt is running with huge budget deficits and it suits them well to save a few billion greenbacks by excluding the legal immigrants...We are anyway nobody's child!

Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.
Are you saying the future greencard applicants will have to compete with lot more new H1b s?? Wouldn't this bill help alleviate the retrogression problem and those with approved LC, I-140 etc??

I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)
I am sure this has happened to others too, but most people will not leak out the news :).
1) If you have dependants who have applied, then they may not get approvals.
2) This was a problem for someone, whose case was posted on Murthy.com. His case was approved when the PD was not current, and he had been waiting to apply for his wife's 485. But since the dates were not current, he could not apply for her 485. So He had to call up CIS and notify them of their mistake.
So is it safe to just get the card and use it? it depends on your luck. They may never discover their mistake or they might. So check with your lawyer.

Yeah there are tons of people who got their GCs with PD 03, but there are tons more waiting in 02 to get their GCs.
Sure there may still be 2002 files waiting but it is definately not a GREAT number. Here are three logical bullets to conslude that.
- Many people with 2000/1/2 dates have already left USA - Tired: Could not
take the delay:Found good oppertunity back home or elsewhere
- Black labor market played a part to shift a considerable load either to EB2 or
PD date from 1999/2000 and thus many people preferred that path either
stuck in EB2 or have already got their GC
The only thing we can be unsure about stuck in NC with those early PDs.
Having said this, it is ofcourse impossible to predict perfect chain of future flow, I see hope for EB3-I in this year, particularly last quarter at least for the people having 2004-Mid and before PDs.

You must promote your state chapter by starting a thread and keeping it alive so those visiting the forums will know. (most people only look at latest threads)

Well , As I have said in my earlier post I contacted the IV powers-that-be to start the Nebraska state chapter about 3 weeks ago, after initial response (asking for my phone number , which I provided) I am yet to hear from them.
Once the chapter is started, I will do whatever is needed to promote the chapter including starting a thread here and modifying my signature.

we are holding off on webfaxes at this time. We will use this when we need them and will be effective. At this time we urge members to take appointments with their lawmaker offices and go and meet them. These meetings are very important for our success. Thus get active in your state chapters. Organize it if it not organized. If you cannot do it for some reason, then take appointments on your own and go and meet them. While we are making efforts on the hill, it is important to have grassroots level efforts going on across the country
