When you say these are the " ONLY REASONS", you should think twice. If your wife delivered baby on that day or if you had back surgery a week ago probably you would not be been in DC for the rally. I completely agree with you. Most people in this forum do not contribute and those who contribute cannot part with more than $20. Yet nothing stops people from making statements like we need answers for disbursement of funds. Nobody held a gun to our heads and made us contribute, we all have vested interests in IV so alteast treat them with respect, and above all be prepared for disaapointments even after the contributions. I tell myself it is an investment or may be a sunk costs, all decisions in life are that way.

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.
I had a similar experience in 2004 when I took Air France for the first time (to Delhi, connecting at Paris). It was the last time I ever took Air France.

I am not indian, I am chinese, and I attended the rally in DC. I am so touched by you brave indian people. while I feel such a shame that we only had much less chinese there. Part of the reason is that IV is originally Indian club. We got the message but kind of lack of close organization.
I explained it to many Chinese I met at the rally that IV is not Indian. Please ask everyone to join IV
Alterego has a good point too. We need professional lobbist to organize more efficient events (in American way). we do have immigration lawyers association, but I guess they don't really represent us.
and besides another rally, we need persistent effort on this by a dedicated group of people, even some full time ( hired them, like a real job), to keep their attention, not just one strike.

USCIS does not work for you or me but sure you can go and ask them for prefiling AOS but not to issue RFE for same job requirement condition and other haressing rfe. how can you say we cannot ask USCIS not to raise RFE for irrelevant stuff,I guess you are ok with all the RFE that are being issued by USCIS on h1 holders currently.

EB3 porting is a loophole like labor substitution.
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

Simple, the power will shift from Rep to Dem from Feb 15th(not sure about this date). So we have to to find a lobbying firm which is close to Dems.
IV go ahead and work on our cause. Some people will lose confidence as if you have guaranteed them something.
For MEMBERS,
IV is a group with folks like us. THey are also working like us and TRYING to get something passed for US. NOTHING is guaranteed by them. They do not have million dollars in their kitty to do the lobbying. What they have is mere 8000+ members in this org and mere 200+ monthly contributing members. What you can expect from them with this kind of support in US. This is not a thrid world country where you can go and bribe to get your job done. You need strong organization with good relationship with lawmakers. To get that, IV needs funds. Nothing would be guarnteed and this should be set in back of your mind. We can expect just the 100% positive efforts to solve the problem we have from IV. This is enough.

You definitely raise an interesting case. What I would say to that is that they just have to reevaluate the points allocation system. the details of the point allocation system may be bad but the overall intent still stands to benefit the highly educated while including the EB system as well will make sure less skilled but in demand people are also taken care off. handling family based GC is a whole diff ball game though.

Prince charming - I invoked AC21 sometime back after 180 days of filing 485 and moved to a new job on EAD.
My ex employer revoked 140. At this point of time I did a lot of research and found out the following things
(1) AC21 letter never reaches your file - there is no system in place for AC21 letter. G 28 gets into the system because there is a process in place for G 28
AC21 is a law that allows you to change jobs but there is no system in place.
(2) AC21 letter must be provided upon request - different officers want differtent information so they generally issue a NOID and ask you to submit evidence in 30 days. USCIS in some cases sends out straight denials. The denial letter generally has information to file MTR within 30 days if the case needs to be reopened due to USCIS error.
In August when my case was being processed, they sent me a NOID but sent my wife Fp notice - I called customer service and was advised that she can go for FP as usual but I have to respond to NOID before they move forward with my case and I promptly responded with AC21 and my case status changed to "Case reopened, response received" and there were soft LUDs hitting my 485.
Keep all documentation ready and be proactive, you can hire a good lawyer from MTR, remember that when you file for MTR, you cannot work - so before you inform your employer, get a letter from them and then inform them - in case employers will be reluctant to give any documentation if they know you cannot work for sometime. If you are on h1b you dont have to worry.
MTR approvals can take 3 to 5 weeks or more too.
if not on h1b you start accruing unlawful status and usually lawyers suggest that you stay till less than 180 days when your MTR is filed - it never takes 180 days for a decision on MTR so dont worry about unlawful status.
These are hidden risks in AC21 but good news is that AC21 cases have always been successful.
You may have to go through this period of uncertainity.

If you guys read the letter a bit carefully, it says they do not have information about the country of chargeability and they cannot share it with us. For $5K all we can get is a breakdown of how many apps are there in each category and then it will be a guessing game of how many are pending for applicants from India/China/ROW etc. Just something to keep in mind.
Can others analyze the letter too so that we can get the info we need rather than generic info.

London does not accept travellers with AP. So Virgin Guys had to turn me back from their counter. I was sure about Qatar having no issues about AP so I went back to Continental and said I need you guys to put me on Qatar and thats what they did.

AI : I love my india , but will not fly AI , because I dont want to take chances with once a year vacation I get.
BA : They are prompt service folks , but I cant tolerate their attitude.
Luftansa: Again good, but cant take the attitude.
cathay/singapore/korean/Arab emirates: Nice , can bet my time and money for my travel on them
Others : I dont really care.

so i understand how the whole 7% thing works now in relation to the total visa's available....
but what i dont get it the fact that EB3 ROW was at Aug 02 in april this year,
then in May it moved to AUG 03, so people were clearly getting through the system....
then in June it moved to June 05 so again in that month people where getting processed, and moving through the system....
then the July fiaco, i guess because they were running tight for visa numbers...ok water under the bridge.....
But now the Oct bullitin which is the start of the new fiscal year puts us back to AUG 02 again........how does that work??? i dont get it. how can they suddenly be dealing with people from 02 when even in May it was up to AUG 03???
I would have thought that with the start of a new fisacl year there would be a full fresh batch of numbers, and people would get through a bit quicker for a least a couple of months...you would have thought that it would be current for the first month on the new allotment....wouldnt you???

The visa quota year ends in September, so the run up to this was the last quarter of the year. Under mounting pressure a combination of the Department of State and the USCIS didn't want to be accused of wasting visa numbers again, so they pushed dates REALLY far forward to make sure they wouldn't.
That drama is now over and we return to the normal state of affairs.
Just because you are a Brit born and bred, don't think you'll get your visa any faster. IF your occupation does qualify you for an EB3 (Bachelors degree or experience equivalency) and you aren't in the states now on any kind of temprorary visa. What I don't understand is, if you aren't in the US now - what employer would sponsor someone for a greencard that won't arrive for about 6 years?

Thanks for sticking with IV!!!. Its a bit ironic that you decided to contribute to IV only after 485 measure failed, which you were opposing. I agree with your message of unity, but that should hold good at all times, irrespective of whether you agree and do not agree with IV. People holding off contributions, heckling IV, questioning IV rationale when they don�t agree with IV is outright selfish and should be avoided at all times.
Couple of days back, I do differed with IV objective to persue only filing of I-485 by Feb 15. Also, one gentleman from this forum asked me to quit IV...
I am of the opinion that "Difference of opinion" to achieve goal is OK but not to loose UNITY...

I wanted to attend but I have pretty much exhausted all my vacation. 2 more days will be pushing it.
Also, the flight schedules to fly from Portland Oregon to D.C is so ridiculous that it takes a whole day away in flying.
Will definetely attend a rally in the east coast, or better yet will help organize one.

We flew from Seattle on friday mrng at 5:30 am. Had a 5 hours lay over at LA. We wanted to be present & it was worth all the pains....
And also must mention, there were 60+ people from CA too...
