Im going to try again ....This whole discussion got so twisted ...so here is the gist to bring everyone back on track.
USCIS's interpretation of law for the "redistribution" of unused visa numbers is as follows (FALL ACROSS) : arrows denote transfer of excess numbers from categories
EB1 -> EB2 ROW/IN/CH
EB2 ROW -> EB2 IN/CH (proportional)
EB2 ROW/IN/CH -> EB3
EB3 ROW -> EB3 IN/CH (proportional)
Ron thinks that this is wrong and it should be as follows (FALL DOWN):

PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.
Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.
PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.
Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.
Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.
An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

Bush is going back to the Capitol hill next week to push for immigration reform. He is hell bent on signing a CIR bill no matter what and Kennedy and durbin know that this there best chance to give amnesty to illegals and screew us Legals EB so this bill is going to be introduced and will pass for sure

It seems like the group I am currently working in will shutdown in few months and more than half of the people have left the group already. I, therefore, need to find a job in next 4 months or so. I am a computer engineer by profession but trying to pursue a career in SAP functional field or DBA and looking for some advise from professionals in the field on training requirements/opportunities, career opportunities in different SAP modules, and how to basically get started.

being EB3I myself, it makes me happy to hear a fellow EB3I getting GC. having said that...
the only and correct question about this whole thing is,
Can & will CIS legally take back the GC (even if its their mistake), in future, when they find out?
The answer sadly is,
Yes, they can, they will, as they already did in a few instances, as reported in these forums.
Not contacting CIS to correct the mistake, with a hope of 'they won't notice' and a logic of 'well, it's their mistake and i have to plead ignorance' is like the idiom, hiding your head in the sand, the Ostrich Effect.

Yes, I used to say like this five years back when I had time and age in my hand. I assume you are in early or mid 20's. I will put it differently for you.
Assume there is a big pond which starts from 1 feet and gradually increases up to 100 feet. People with one year work experience steps 0.5 feet. There are life jackets(GC) floating around the pool and whoever is lucky is picking it up. There are guys like me who are already in 5th-6th feet deep without finding the lifejacket, but we are sure if we go further, may be 3-4 feet more we WILL find it. There are guys who are lucky to find a life jacket at 1,2,3 feet also and happily float to the shore passing us. The fifth feet guy is practically seeing how the 6th and 7th feet guys are struggling. May be they are seeing some one in 8 feet to 10 feet. Now a big Tsunami (retrogression) comes and drags all the jackets 20 feet down further. These guys are dejected and some of these guys even pull their spouse/kids in one hand when they float/swim.
Dont forget, it takes one year to step 0.5 feet. Every year the pond management drops a fixed number of jackets. These guys keeps their hope alive based on the above fact. But these guys are seeing some kids passing in motorboat(LC Substitution) paying that guy 10K and getting a life jacket. Hmm pain, but even if I had a chance I would have also done it.
Now comes your saying. When the deepest s...t guys talks about their fate down the line and how to take their family safe ashore, a guy at 0.5/1 feet shouts saying "Dont give up, it is like deciding to take a sanyas because you are tired of dealing with social issues".
If you are in 5+ feet, I take your statment. Otherwise, you will not understand what I am trying to say until you reach 5+ feet without finding a life jacket and also pulling your family in one hand and seeing your seniors struggling more in 8+ feet. :)
NOTE: BTW, no offense. I thought to express what I am saying in different way. I understand what you meant. Cheers.
I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in..:rolleyes: Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

You do not need to have an SSN in 2008, since you can apply for the stithmulus payment in 2009 if you did not get it in 2008. This rule is posted on the IRS website.
The IRS webpage is saying something different. It makes it clear that you need the
SSN in 2008. (Second and last question on

Please do not refer to the stimulus payment as a rebate in any communications you have. It is not a rebate, which implies the return of money paid. Many people who earn no taxable income can apply for the stimulus payment. This makes it different from any tax scheme. additional child tax credit. I got more money back then I paid, i.e., I had to
pay a negative amount of federal tax :-) (So this country is so mad that it
gives me an H1-visa for working and in addition pays me some money
for staying here.)

I accept what risker says.. I am also one of the people with PD 2003 and waiting for the backlog center to send my ad instructions and my friends & neighbours with PD 2005 have all filed I140 & I485 with current fees and expecting their EAD and AP soon. Where is justice? I am in. Common guys pls. join risker.

Frankly speaking, i am not a sufferer from BEC, but i want to know more about this mess.
Does the FIFO means, they process the applications in FIFO order, Does it mean that they approve also in the FIFO order? I think both processing and approving are different. Whoever got the case with less complications, will first get the approval and whose case got more complications, takes more time. Is it correct? I may be wrong. I think thats the reason why 2004 PDs may come out BEC fast sometimes as they put the case strongly and clearly.

I am very glad that you brought this point. Nothing would give me greater pleasure than suing the DOL. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.
Some folks have pointed that the lawsuit is not worth, as it has little chance of winning. To me personally, more than winning or loosing, it is a matter of bringing injustice to the light, as Gandhi has said something in this line: First step against injustice is to make it visible. This law suit will bring public scrutiny to the misdeeds of the DOL.
Even if all the backlogs get cleared by September 2007, severe damage has been already dealt to our lives. Though I am close to getting my labor clearance (I filed RRI few weeks back), I am strongly in favor of continuing with the law suit even after getting the labor clearance.
Let’s get IV’s attention and support in this area. Let’s talk to AILA. Let’s write letters to senators and house representatives (congresswoman Lofgren may be good person to start with). Let’s write to media personnel. Let’s do whatever needs to be done to expose this insult and injury to the immigrants who waited in the line for years and followed rules of the game.

Employer B applied for H1B transfer and it was approved in september,2008.But I am still in the payroll of employer A and have not joined B yet(no paystubs etc). Employer A knows this and has not revoked my H1B (visa valid till december 2009 and have got it stamped already). I would like to travel to India in this situation (emergency).
I still intend to work for A after my travel.
1. Will it be a problem at the port of entry with my visa transferred to B,but me still being the payroll of A and intend to continue with A after my travel? (my H1B visa with A is valid till december,2009)
2. What supporting documents do I have to carry with me other than a recent employment confirmation letter,paystubs from employer A?
Currently, I am into the 2nd year of the first 3 years of H1B.I checked with my attorney and she said its ok to come back with the employer A visa.
Please let me know.
