Yes, you are right. It shouldn't take years to make a decision even if it is complicated. I think they may be not working on those cases at all. That may be the reason, they didn't comeup with any decision. It will be good if DOL gives the operating procedures and comeup with fair action on what they are really doing.
My case was filed in 2002 under traditional labor certification. DOL never questioned anything or asked for any clarifications (so I assume there were no complications). The job was advertised in last April (it was a little newspaper advertisement with few lines and very generic job requirements). There were no resumes received. But still I have not received my labor approval. So what baffles me most is why has the DOL been not able to taken any decision on my case even after 5 years. I applied for my labor during sept 2002.Just before my labor getting cleared, they started this BEC 's and sent my application to PBEC and it it was cleared during 2006 April.( after 3 and 1/2 years)
During this period I got one year of extension for my H1B and sent papers to the attorney for I-140.That stupid attorney did not file my I-140 for the next 4 months just like that.( god only knows what happened bw, my employer and attorney). and at last we changed the attorney and applied for I-140 during 2006 November. and during 2007 Feb I put my I-140 for premium processing.

Quick question on behalf of my friend. His H1B is being revoked by the present company. His previous employer did not revoke his H1B, can he go back to the previous employer without filing for transfer or should he file for the transfer again?

If you filed early May and received a Notice of Receipt from USCIS, that means your I-485 is already in process, and you have been assigned an Alien Number already. The announcement from INS is very clear, "Effective Monday July 2, 2007 there will be no further authorizations in response to requests for Employment-based preference cases". It says EFFECTIVE JULY 2 and "NO FURTHER" right? That means the only ones affected are applications received July 2 and onwards.

It makes them wonder whether the USCIS' claim that they're out of visas also applies to them. It may sound simple to you, but neither you nor anyone here really knows what is going on in their minds up there, there are only speculations. If we knew what was happening, there wouldn't be so much discussion.

I work for the fortune 500 company, fragomen filed my case very last minute (just a day my 5th year finishes). I do not know why they did like that though the HR initiated my GC long time back. I found many of my friends also had similar issues. They really test your patience. One of my friend's case, they have totaly screwed up by filing last minute.

I dont see anything which will allow us to file for 485 as soon as the labor is approved, s1932 had a point whcih would allow us to file for 485 without waiting for the priority date.
Or am I missing some thing.

The word on the street is that the Cantwell amendment is not a part of the list of amendments that are currently floating around in Senate offices. There are 20 of them.
Even Bernie Sanders has one more coming (Yes, it is related to H1B). But Cantwell amendment is not there in the list of 20.

I must say that this is a great great effort. Both, the flower campaign and the rally. Nothing like this has been done before by wanna-be immigrants. We are hardworking, law abiding, well educated people. But until now, the general opinion was that we are at the mercy of the American immigration system. I was especially so frustrated when some of my friends thought that there was nothing wrong in what the USCIS did. Their response was simply "what can we do? let's just re-apply when the dates become current again". Historically, Indians (at least, from my experience) have been hesitant to protest against the wrongdoings of their rulers. This is seen even today, when we fear to raise our voice when our bosses or managers at work exploit us, or our advisers/professors exploit us, or if the USCIS changes rules in the middle of the game. In India too, the general opinion is "Nothing is going to change, let's not get into trouble". This rally has shown that things are changing. We all should wake up, and fight for our rights! I could not attend the rally as I am based in Michigan, but I thank all of you who protested for me and my family. I will do my best to support this effort in whatever way I can.

I just thought of starting this thread for people who did not attend. Please explain in one or two sentences why you did not attend. Whether it was a personal reason, whether u were scared, didn't care, forgot, didn't know! etc.
My reason:
I really wanted a green card, but because India is growing so fast, I really don't think I want it so badly anymore. So, I did not have the motivation to go ...
I am honestly curious. What changed in two months? You were desperate then, and you are not now?
