    Dear Members,

    We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.

    Our angst, our insecurity:

    Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.

    Early effort wins:

    The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.

    How you can help:

    You and help in two different ways:

    Join the advocacy effort in DC on June 7th and 8th. (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1437978-iv-announcement-advocacy-days-in-washington-dc-7th-and-8th-june.html) If you have never done this before, we encourage you to help us with this and join us. Immigration voice will arrange the logistics of setting up meetings and arranging the material for you to take to your Congressmen and Senators. We are expecting about 150 immigration voice members to gather in DC and participate in over 200 meetings with Congressmen and Senators.

    Contributing Funds to help finance the effort (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1534974-funding-drive-iv-needs-your-support-for-advocacy-events-in-dc.html). You are most welcome to come to DC and join us but if your job demands are such that you cannot take two days off on June 7th and 8th, then you can still contribute to this effort by contributing financially to Immigration Voice.     I just got laid off.

    I am an EB2 (Jul 15, 2007 priority date). I jointly filed my I-140/I-485 5 months ago (1 month inside the 6 month period to become 'portable'). I was at Merrill Lynch; they said they do not typically inform immigration of laid off employees and the lawyers feel that I should still be able to get my I-140/I-485 (hence, my greencard) desp. They said, due to the current economic conditions (and subsequent large numbers of layoffs) US immigration is not to 'stick'y on the 6 month requirement for portability.

    Does this sound plausible? Is there anything I need to be aware/careful of? Does it seem likely I will need to start my greencard (PERM) process from the beginning again?

    I am working on this with some lawyers, so be patient. The Stimulus payment is a benefit, regardless of what the SSA says, but you don't need to do anything else now. Just keep any communications you have with them in case you need to refer to them later. You do not need to have an SSN in 2008, since you can apply for the stimulus payment in 2009 if you did not get it in 2008. This rule is posted on the IRS website. I also have significant documentation the PROVES this is a benefit, in addition to the material I posted in the OP.

    From the Wikipedia article that you referred to:

    Federal Benefits
    The transfer of money, property, services, or anything of value, the principal purpose of which is to accomplish a public purpose of support or stimulation authorized by Federal statute,…and includes, but is not limited to, grants, loans, loan guarantees, scholarships, mortgage loans, insurance…, property, technical assistance, counseling, statistical, and other expert information; and service activities of regulatory agencies.

    Also, the SSA defines a benefit as follows:

    20 CFR Part 422 [Reg. No. 22] RIN 0960-AF05 Evidence Requirements for Assignment of Social Security Numbers (SSNs); Assignment of SSNs for Nonwork Purposes, a "valid non-work purpose" results when the "law requires an alien who is legally in the U.S. to have an SSN in order to receive general public assistance benefits (i.e., a public benefit that is means-tested) to which the alien has established Entitlement."

    I have a ton of documentation to support our case, but I don't want to post it here until I have had a chance to discuss our strategy with the lawyers who are working on this.

    Please do not refer to the stimulus payment as a rebate in any communications you have. It is not a rebate, which implies the return of money paid. Many people who earn no taxable income can apply for the stimulus payment. This makes it different from any tax scheme. The fact that the IRS administers the program does not prove that it is a tax program. Moreover, official IRS documents refer to the stimulus payment as a benefit similar to food stamps, not a rebate.

    And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

    That's ridiculous. Forget abt the 2 year EAD that you didn't get, you also lost 3 months? They probably hired some part time workers for last weekend who might have screwed up. I did some research before and am pretty sure they started issuing documents with a start after expiry of the first one a long time ago. Even on our AP's which were approved, the start date was september 2008. I got them mid -may..

    I filed my labor twice with Fragomen and got rejected in 2001 and 2002.
    Just for H1B visa extension they took more than 9 months. Although they have all my papers for months. Eventually, I had to leave my employer for good.

    Stay away from them if you have choice.

    I agree with OP that we should know what's going on. But at the same time there is nothing called free lunch in this world. I suppose some guys in this forum have lot of time and energy to vent it out on each other. We won't achieve anything with all this fighting... but seems we are best in altercating with each other. Some times I just wonder whether folks out here are really skilled immigrants (gimme red dots)?? We should better do something constructive..

    I realized making a small contribution will not hurt me even in this economy... so contributed $25.

    I had a similar experience, i took matter with the consul general, other than making an apology in the written e-mail I dont think he took any steps in improving the Customer Service @ SFO consulate office. I sent them US postal Money order, so i dont think they duped me...it just cost me extra $20.

    Babu mentality is still their for any Govt of india employee and no matter what position they are holding, they all behave same, very rude and corrupt minded, always looking for an opportunity to make quick bucks using their position. Though in your case if you would have write the money order or cashier's check in favor of the consul general, Govt of india account, i dont think they have any legal way to encash these check or money orders in favor of them.

    I guess the fraud is when folks send them $20 bills, thats very easy way of stealing the money and especially when they send you the PIO card in the same original envelope which you sent. Something suspicious. Write to WAshington DC office and see if they take any action.

    It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
    of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
    for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.

    coming to US/Canada vs india, my friend who went back to india after 6 yrs here on h1b last april, says that he has adjusted back to his life there.......he has power cuts,limited water supply,traffic jams,long commute,sarkari issues like bills etc (hes in delhi)but he has accepted that as a part of life just like the first 25 yrs of his life when he was in india......so its very subjective and a matter of personal choice.......if u are ready to adapt,then u will be fine but if u always keep comparing ur lifestyle here v/s in india in terms of "quality of life" then u'll not b satisfied

    My company went through a 10% workforce reduction company-wide just when my PERM application was ready to be filed. Although nobody from my group has been affected, 2 people with the same job title from a different group in the same office were affected. Their job descriptions are entirely different. I have about a year and a half before my H1B expires. I would appreciate anybody answering the following questions I have:

    1. In Form 9089, should the answer to Item 26 be 'No' since nobody in my group or area of expertise was affected?

    2. If the answer to Item 26 should be 'Yes', is it sufficient to notify and consider the people laid off? I am confident that they will not qualify for the position. How long should this 'notification and interview' period typically be?

    3. I have heard that my company can be sent an audit notice. In such a case, is it sufficent to justify that the area of expertise is different. What is the success rate for this?

    4. If the audit response is rejected, what happens then? I have been told that the employee will have to return to his home country immediately and cannot refile his PERM application.

    Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.

    I had a similar issue.. labor was stuck in the backlog ctr for 4 years.. Tired of waiting - i then directed my lawers to request the dol for a screenshot, ven though my h-1b was valid and i did not actually need it.. lo and behold.. 15 days after that .. it was miraclously approved.. I suggest you try the same.. keep me posted if that works.

    In my opinion Let's contribute $100 each pay them and get this information. I'm sure there'll be 50 people who would want this information for $100....Atleast I'm sick of seeing Visa Dates predictions and seeing Visa bulletins itself. Atleast we'll know what we are dealing with.
