Hi Guru's,
I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:
1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.
Q & A:
1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.
Your valuable suggestions are greatly appreciated.

Hi Experts,
My wife is on H4 visa and has started her MS in CS in Jan. She applied for her change of status to F1 visa on 15 th feb. As of today (17th March), her approval notice hasnt come and her H4 is expiring on 31st March. I am not even able to follow her case online on USCIS coz her return recipt number is not updated at all. This is quite common I have heard.
My question is, should we also apply for her H4 extension before 31st of this month so that in case her approval for F1 does not come before her H4 expires and in worst case it gets rejects, she still wont be out of status coz her H4 renewal application is in place or am i just being too paranoid and should just wait for her F1 to come??

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Hello gurus..
I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?
All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

I-140 is not specific to country - the date for each processing center applies to all countries

I-140 processing date isn't country specific, but make sure check the date for the center you have applied to - the date varies by center

Hi,
I was working with a company in H1-b visa, and after 3 years renewed our H1 and H4 with the same company,
and both got extended upto 30th September 2011 . Later, i have transfered our H1 and H4 to a new company
in January 2009, and H1 extended from 10th January 2009 to 4th January 2012. After 3 months H4 approved
from 1st October 2011 to 4th January 2012.In short, H1 approved from the applied date of the last H1 to
4th January 2012, but H4 approved from the expiration date + 1 day of the previous H4 to 4th January 2012.
Since, i'm with a new employer what is the status of the H4 now. Looking for your valuable suggestions.

Since first day, if u have tried to make I485 filing w/o priority date current..
At least 90% of people wud have utilized AC21 and change employers.
Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
As long as we file 485 and utilize AC21, we will be in safe situation.
Have some plan and result oriented plan.
Thinking big is ok, but we shd know what actually we can do.

I am having a problem and dont know where to start on this one, my experience in c# programming is average and was hoping for some advice on this subject. I have a disc image (an exact duplicate of a 40gb hard disc drive) the format is a dd image.
My task requires me to programmatically read through the files on this image, compare file extensions and recognise certain file types on the drive. Is this possible? I cannot find anyone who has attempted this on the internet and would appreciate any guidance to get the ball rolling.

Hello
My friend is in USA on F1 visa and her wife and daughter denined visa twice with reason that my friend is studying here not working.
Even he is not offering sponsership to her wife and kids. His in laws are sponsering both of them. Now he wants to invite them on his graduation day. Can he get a letter from local senator with F1 visa status ? or is that only for people who pays taxes . ( H1b or l1b ) ?
Please advise.

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!
However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.

I recently got my EAD card. I intent to continue to work full time with my current employer. I want to work part time with another employer. My H1 is stamped and valid untill end of 2008.
If I use my EAD card for part-time job, does my H1 get invalid?
If yes, do I need to inform my fulltime employer about change in status?
If no, can I travel outside USA with the H1 visa for reentry?
Please help.

I need some clarification. One of my friend confued me.:confused:
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
