1)I graduated in masters in december 2008.Iam working on OPT extension which expires on june2,2011.Iam thinking to apply for H1.Accordint to current situation,can i submit H1 application after october 2010 also? as CAP will be still open for masters quota(hoping)?can i put start date immediate after my opt status expiry date or it will start only on conventional date oct1st of every year?
2) Iam planning to fly India in between mar 2011 -may 2011 for 1month...so if iam approved with H1(if above questions says yes) then i need to go to H1 stamping and when i enter US ...i need to change my status from opt to H1 right at US entry.
3) if iam going in apr/may 2011 when should i start the H1 processing?(it should be before 6months only)

CAN WE APPLY 140 and 485 without physical Labor APPROVAL?
My lawyer emailed me saying that she called P-BEC and my LC is approved. We neither have the physical paper nor the online status shows "In-Process"

Hello All,
I need ur advice.
My H1 expires this sept 19th 2010. I don't have the present H1 stamped.
Also, I have the new extended H1 which is valid from Sept 19th 2010.
Now, I'm planning to travel to India and go for stamping.
1. If I go for stamping before sept19th, on which H1 will i get the visa stamped,present H1 or the new extended H1?
2. Is it safe to go before sept19th or after sept 19th? I prefer the stamping on H1 extension.
I'm flexible with my travel.
I'm waiting to book my appointement based on the advice given.
Appreciate ur inputs!!

I am going to complete 6 years on H1-B by 2009 March. When we applied for the H1-B Transfter to my current company last year for some reason I got the extension upto Jan 2010 which is more 6 yrs.
I was on L1 until 2004 Jan for 9 months in the begining and my previous company converted L1 to H1 in Jan 2004.
My question is do I need apply H1-B extension on approved I-140 to get 3 more years extension as 2010 Jan will be my 7th year on H1-B ? OR I can wait upto current transfered H1 - B approval validity?
Please advise.

Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

In the purpose of trip to USA question: the given options are business, travel or student visas, so i selected the option: "other". On selecting this, the form loads a list of further options in order to SPECIFY: the H4 option (dependent of H1B holder) is not given in this list. The nearest applicable option is "temporary employee H1, H2". When I choose this one, then at a much later stage in the application, in the section titled "temporary work visa information" the form starts to ask information on my supposed employer etc, which is clearly UN-applicable in my case, as I am NOT applying for an H1 or H2 visa. Kindly help me out, on how to proceed with DS160 in such a situation. Waiting for reply with anticipatory thanks. Sadatj.

Hi All,
I went for visa interview in December, but my case was stuck because of administrative processing. I came back on Advance parole. I have the following questions.
1. Can I sponsor my parents visitor visa without any issue? Will the consulate quiz them/stop them because of my H-1 admin processing
2. Also is my admin processing still going on? and can I stamp my H-1 visa in the future after my case is cleared from admin processing.
